FOMEDI respects the intellectual property rights of others and expects users, instructors, and other contributors to do the same.

This Copyright and Intellectual Property Policy explains how FOMEDI handles intellectual property rights and reports of alleged infringement.

Intellectual Property Owned by FOMEDI

Unless otherwise stated, FOMEDI and its licensors may own or control intellectual property rights in materials associated with the Services, including:

  • FOMEDI trademarks and branding;
  • Logos;
  • Website design;
  • Platform software;
  • Original text;
  • Graphics;
  • Interface elements;
  • Original promotional materials;
  • Other materials created or provided by FOMEDI.

You may not copy, reproduce, modify, distribute, sell, license, publicly display, or commercially exploit FOMEDI-owned materials without prior written permission, except as expressly permitted by law or our Terms of Service.

Instructor-Owned Content

Instructors generally retain ownership of intellectual property rights in original course content they own.

By publishing content through FOMEDI, instructors grant FOMEDI the license necessary to operate, promote, distribute, and provide the applicable course through the Services as described in the applicable Instructor Agreement.

User-Submitted Content

Users may submit reviews, comments, questions, profile information, or other content.

Users retain ownership of intellectual property rights they own in their original content.

By submitting content through the Services, users grant FOMEDI the rights reasonably necessary to host, display, reproduce, distribute, and operate the relevant feature or Service, subject to applicable law and the Terms of Service.

Copyright Infringement Reports

If you believe that content available through FOMEDI infringes your copyright, you may submit a copyright infringement notice.

Your notice should contain sufficient information for FOMEDI to evaluate the complaint.

Where applicable, a copyright complaint should generally include:

  • Identification of the copyrighted work allegedly infringed;
  • Identification of the material allegedly infringing the copyright;
  • Information reasonably sufficient to locate the material on FOMEDI;
  • Your contact information;
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law;
  • A statement that the information in your notice is accurate;
  • A statement that you are authorized to act on behalf of the copyright owner, where applicable;
  • Your physical or electronic signature.

Please do not submit unrelated customer-service requests through the copyright reporting channel.

Counter-Notifications

If content was removed or access was restricted because of a copyright complaint and you believe the removal was made in error, you may submit a counter-notification where applicable.

A counter-notification should generally identify:

  • The material that was removed or restricted;
  • Where the material appeared before removal;
  • A statement explaining why you believe the material was removed in error or misidentified;
  • Your contact information;
  • Any legally required statements and consent to applicable jurisdiction;
  • Your physical or electronic signature.

FOMEDI may forward appropriate counter-notifications to the complaining party as permitted or required by applicable law.

Repeat Infringers

Where appropriate and legally permitted, FOMEDI may restrict or terminate accounts of users or instructors who repeatedly infringe intellectual property rights.

FOMEDI may also take other actions reasonably necessary to protect intellectual property rights and the integrity of the Services.

Trademarks

FOMEDI names, logos, designs, and other brand elements may be trademarks or service marks owned by FOMEDI or its licensors.

You may not use FOMEDI trademarks in a way that:

  • Creates confusion;
  • Suggests an unauthorized affiliation;
  • Implies endorsement;
  • Damages the FOMEDI brand.

Third-party trademarks remain the property of their respective owners.

Third-Party Materials

Courses and other content available through FOMEDI may contain third-party materials.

Instructors and users are responsible for ensuring that they have the necessary rights, licenses, permissions, or legal basis to use third-party materials they submit.

Examples may include:

  • Images;
  • Music;
  • Video;
  • Text;
  • Software;
  • Logos;
  • Fonts;
  • Educational materials.

Fair Use and Other Legal Exceptions

Copyright law may permit certain uses of copyrighted materials without permission in specific circumstances.

FOMEDI does not determine whether a particular use qualifies as fair use or another legal exception in every case.

Users and instructors are responsible for evaluating their own legal rights and obligations.

Removal of Content

FOMEDI may remove, restrict, disable access to, or otherwise take action regarding content that is alleged to infringe intellectual property rights.

FOMEDI may also take action where content creates legal, security, or operational risks.

FOMEDI may request additional information from the reporting party or the content provider before taking further action.

No Guarantee of Complete Monitoring

FOMEDI does not guarantee that all content uploaded or published through the Services will be reviewed for intellectual property infringement before publication.

Users and instructors remain responsible for the content they submit.

Changes to This Policy

We may update this Copyright and Intellectual Property Policy from time to time.

The updated version will be posted on this page with a revised “Last Updated” date.
